Agreement to Terms

By downloading or using dérive, you agree to these Terms of Service. If you do not agree, do not use the app.

Use of the Service

dérive is a personal place-saving app. You may use it to save, organize, and revisit places for your own personal use.

You agree not to use dérive to: • Violate any applicable law or regulation • Attempt to gain unauthorized access to any part of the service • Interfere with or disrupt the integrity or performance of the service • Scrape, copy, or redistribute content from the service without permission

Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at kevin@ourderive.com if you suspect unauthorized access.

Subscriptions

dérive offers a free tier and a paid subscription (dérive Pro). Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your iPhone Settings under your Apple ID.

Your Content

You retain ownership of any notes, photos, or other content you add to the app. By using dérive, you grant us a limited license to store and display your content solely to provide the service to you.

You are responsible for ensuring your content does not violate any third-party rights or applicable laws.

Intellectual Property

The dérive app, website, and all associated content — including the name, logo, design, and software — are owned by us and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of dérive without our written permission.

Disclaimers

dérive is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components. Place data is sourced from third-party providers and may not always be accurate or up to date.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of dérive.

Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms. You may delete your account at any time by contacting us at kevin@ourderive.com.

Changes to These Terms

We may update these terms from time to time. We will notify you of material changes through the app or by email. Continued use of dérive after changes take effect constitutes acceptance of the updated terms.

Governing Law

These terms are governed by the laws of the State of New York, without regard to its conflict of law provisions.
